Lawsuit faults Gander Mountain for failure to read minds



Gander Mountain's Rochester outlet sold guns to a customer who filled out and certified the veracity of her entries on ATF's Form 4473 "Over the Counter Transaction Record," and passed the NICS check, clearing the transfer of the guns. They're being sued for that by the Brady Center on behalf of shooting victims and families, because the purchaser then turned the guns over to a "prohibited" felon, who went on a shooting rampage.

Is Gander Mountain supposed to assign someone to follow all of the gun purchasers around to make sure they don't break any laws?



Gander Mountain is being sued for following the law to complete firearms transactions, and for not having ESP and being able to read minds, and look into the souls of other human beings. Gander Mountain is being sued for not having special powers and abilities not possessed by any other mortals, but expected and required of gun dealers.


I don't have ESP, so I guess I'm open to being sued if a customer goes on a shooting spree with a gun they gt from me. The judge should dismiss this under the "Lawful commerce in arms" act. It is supposed to protect manufacturers and dealers from frivolous lawsuits like this one. We have no control over what a  customer does when they walk out that door.



Suing a manufacturer or dealer over a defective product is one thing. This is completely different. As a dealer, I can tell you that a lawsuit like this scares the living hell right out of me.



Gander Mountain is being sued because it has deep pockets. And most of all, Gander Mountain is being sued because it has committed an unforgivable offense: It sells guns, a trade the antis are determined to impede, to harass, and ultimately, to terminate.


I don't have deep pockets. All it would take is the treat of a lawsuit and I  would be ruined. My very small business and probably even my home and cars would be gone just to try to find a reasonably competent attorney. That's what the gun  haters want. They want to put as many dealers as they can out of business. And Bloomberg is going to finance the effort.

Elijah Cummings’ Plan for a Police State Run by a Federal Czar

The letter calls for the appointment of a federal czar within the Justice Department to monitor and oversee local police departments that receive federal funding.
Read the rest and be as scared as you need to be.  This is the police state that Orwell showed us in 1984.

You need to be writing to your Congress critter and demanding that this crap has a stop put to it.

Don’t let a good crisis go to waste. It sounds like a new pen and phone action by Obama is coming our way.

Why Not Compromise?



I'll compromise with the gun haters. If they will promise to leave me alone, I promise not to shoot them in the face. That's all they are going to get from me. A gun hater told me once that the government will come and get my guns whenever they are ready. I responded that I would much rather die in the street, shot by a government thug, than to stand next to a pit and be shot by a government thug. 



There has never been any "real" compromise in the gun debate. What have the gun haters given up? Gun owners are saddled with the Brady bill that says that every gun sold through a dealer must go through a background check. When that law was passed, just what did the gun haters give up? Nothing. They got their background checks and we didn't get anything but more loss of our rights. I get so tired of hearing the gun haters talk about "common sense" gun laws and compromise. Here's a good compromise for them. They got background checks, we should get suppressors off of the NFA restrictions and every gun owner that wants one should be able to go to the local gun emporium and buy all of them he wants. No forms, no special tax stamp, period.

Long weekend health update

Last weekend started Friday morning and was just like any other day. Coffee at 6 and then doing different things until lunch. She had complained earlier that she didn't feel good. We thought after lunch she would get feeling better. That didn't happen. At 3:30 we decided a trip to the urgent care clinic was in order. We thought that maybe her diverticulitis was acting up. Checked by the doctor and he was thinking the same thing. He was going to prescribe some antibiotics and send her home. That is until a wave a pain got her and she almost ended up in the floor. Change of plans. He sent us to the main hospital for a CT scan. She got to drink a bunch of that wonderful contrast and it took 2 hours to get that done and get the scan.

At about 0100 on Saturday morning, we had a bouncing baby appendix. They got her into a room and I finally got home a 0300 for a short nap and to let the dogs out. They were really happy to see me. They sent her home at 300 Saturday afternoon and she has been recovering nicely. I don't imagine she will go to work this next weekend since she's going to still be healing.

In other health news. My brother is finally home after falling off a roof. He spent 2 weeks in the hospital ans another 6 weeks in a physical rehab. He's home now with his shiny new wheelchair. He has a set of braces and a walker and he's determined he's not going to be in that chair too long. He's got a  long way to go, but knowing him and how our family temperament is, he'll beat it. He may have to use some type of device to help him, but he will walk again. Right now he's getting the synthetic heroin out of his system. I was on that crap for a year and it's not anyway to have quality of life. I know I spent that year as a slobbering mess. The whole time he was in rehab he was hard to understand because of it. Now that he's off of it and one some non-narcotic pain meds I can understand what he's saying.

Me, except for that parts that were broken years ago, I feel fine. It's bad when the broken and crippled up on feels better than everyone else.

John Kirby, the Pentagon press secretary, said the program also has assisted police across the United States in counter-narcotics and counter-terrorism operations that “get right to the protection of the homeland.”

“I want to make sure that it’s clear that this isn’t some program run amok here, or that there isn’t proper accountability,” Kirby said. “There is. And it’s well thought-out.”




If they have it, they will use it.
